1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of maravellaaesthetics.com (the "Site") and your engagement of services from Maravella Aesthetics ("Maravella," "we," "us," or "our"). By accessing the Site, booking an appointment, or receiving services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

2. No Medical Advice; No Provider-Patient Relationship

The content on the Site, including descriptions of treatments, educational articles, and social media content, is provided for general informational purposes only. It is not medical advice and is not a substitute for consultation with a qualified healthcare provider.

Viewing the Site, submitting a form, or corresponding with us electronically does not create a provider-patient relationship. That relationship is established only after an in-person consultation, completion of intake and medical history documentation, and acceptance of you as a patient by a licensed Maravella provider.

Always consult your physician or a qualified healthcare provider regarding any medical condition. Never disregard professional medical advice or delay seeking it because of something you read on the Site. If you are experiencing a medical emergency, call 911.

3. Eligibility

You must be at least 18 years of age to book or receive services, or a minor accompanied by a parent or legal guardian where the treatment is permitted by law and approved by our providers at their sole discretion. Certain treatments are not available to individuals who are pregnant, nursing, or who have specific medical conditions or contraindications, as determined by your provider.

4. Consultations, Treatment, and Consent

  • All treatments require an initial consultation and a completed medical history.

  • Every treatment requires a signed, treatment-specific informed consent form reviewed with you before service.

  • Our providers reserve the right to decline or discontinue any treatment when, in their professional judgment, it is not medically appropriate, safe, or in your best interest.

  • Treatment plans are individualized; recommendations made to one patient do not apply to another.

5. Results Disclaimer

Individual results vary. Aesthetic outcomes depend on anatomy, skin condition, age, health status, lifestyle, adherence to aftercare, and other factors outside our control.

  • No specific result, degree of improvement, or duration of effect is guaranteed, promised, or warranted.

  • Before-and-after photographs, testimonials, and reviews shown on the Site or our social media reflect the experience of specific individuals and are not a guarantee that you will experience comparable results.

  • All medical and cosmetic procedures carry risks, which will be reviewed with you in detail during consultation and in your informed consent documentation.

  • Some treatments require a series of sessions and periodic maintenance to sustain results.

6. Medical Weight Loss Services

Medical weight management services, including prescription medications, are provided only following a clinical evaluation and only when clinically appropriate. Prescriptions are issued at the sole discretion of a licensed provider and are never guaranteed. Participation requires ongoing follow-up, monitoring, and adherence to the plan established with your provider. Weight loss results vary significantly between individuals, and no specific amount of weight loss is promised. Medications are dispensed or prescribed in accordance with applicable federal and Arizona law.

7. Appointments, Deposits, and Cancellations

  • Booking: A valid credit card and/or deposit may be required to reserve an appointment.

  • Cancellation window: We ask for at least 24 hours' notice to cancel or reschedule.

  • Late cancellation: Cancellations inside the notice window may result in a fee of or forfeiture of your deposit.

  • No-show: Failure to appear may result in a charge and may require prepayment for future bookings.

  • Late arrival: Arriving more than 15 minutes late may require rescheduling, as we reserve full, unhurried appointment time for each guest.

  • We reserve the right to reschedule appointments due to provider illness, emergency, or circumstances beyond our control.

8. Payment, Pricing, and Refunds

  • Payment is due at the time of service unless otherwise arranged in writing.

  • Prices are subject to change without notice. Pricing quoted during consultation is valid for day of service.

  • All services rendered are final and non-refundable. Because aesthetic treatments are performed on the body and cannot be returned, we do not offer refunds for completed services, including where results differ from your expectations.

  • Prepaid packages and treatment series are non-refundable and non-transferable, and expire 365 days from purchase, unless otherwise stated.

  • Retail skincare products may not be returned - no exceptions.

  • Complimentary touch-ups or adjustments, if offered, are at our sole discretion and subject to the specific terms communicated at the time of treatment.

  • We do not bill insurance. Cosmetic services are generally not covered by insurance.

9. Gift Cards

Gift cards are non-refundable, non-transferable, and may not be redeemed for cash except where required by Arizona law. Lost or stolen gift cards will not be replaced without proof of purchase.

10. Photography and Media

With your separate written authorization, we may take clinical photographs before, during, and after treatment for medical documentation, and — only with your additional express written consent — use images in marketing materials, on our website, or on social media. You may revoke marketing consent at any time in writing, though we cannot recall materials already distributed. Clinical documentation photographs are retained as part of your medical record regardless of marketing consent.

11. Intellectual Property

All content on the Site — including text, graphics, logos, the MARAVELLA AESTHETICS name and marks, photographs, video, and design elements — is owned by or licensed to Maravella Aesthetics and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, republish, distribute, or create derivative works from any Site content without our prior written permission.

12. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms

  • Attempt to gain unauthorized access to the Site, our systems, or patient data

  • Submit false, misleading, or fraudulent information

  • Introduce viruses, malicious code, or automated scraping tools

  • Harass, threaten, or abuse our staff, providers, or other patients

  • Post defamatory, obscene, or infringing content on our social channels

We reserve the right to refuse service, terminate accounts, and remove content at our discretion.

13. Client Conduct

Maravella is committed to a safe, respectful, and welcoming environment. We reserve the right to refuse or discontinue service to any individual who behaves inappropriately toward staff or other guests, arrives under the influence of alcohol or non-prescribed substances, or provides materially false medical history.

14. Third-Party Services

The Site may link to or integrate with third-party services including scheduling platforms, payment processors, and social media. We are not responsible for the content, availability, security, or practices of third-party services, and your use of them is governed by their own terms.

15. Mobile

  1. Messages related to your account, orders, services, appointment reminders, marketing and promotional messages may be received. Frequency may vary.

  2. You can cancel the SMS service at any time. Just text “STOP”. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

  3. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at info@maravellaaesthetics.com.

  4. Carriers are not liable for delayed or undelivered messages.

  5. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

16. Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Nothing in this section limits any warranty or duty that cannot be disclaimed under applicable law, including the professional standard of care owed to patients.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARAVELLA AESTHETICS AND ITS OWNERS, PROVIDERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, INCLUDING RELIANCE ON SITE CONTENT.

This limitation does not apply to claims arising from professional negligence in the provision of medical services, personal injury, or any liability that cannot be limited under Arizona law.

18. Indemnification

You agree to indemnify and hold harmless Maravella Aesthetics and its owners, providers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Site, or your provision of false or incomplete medical information.

19. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

Note: Arizona has specific requirements for medical malpractice claims, including expert affidavit requirements. Arbitration clauses in healthcare agreements are subject to additional scrutiny — have counsel confirm enforceability before publishing this section.

20. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

21. Changes to These Terms

We may modify these Terms at any time. The "Last Updated" date reflects the most recent revision. Your continued use of the Site or our services after changes are posted constitutes acceptance.
